TERMS OF SALE
The owner of the online store kittlemood.ee (hereinafter the Online Store) is OÜ Kittel Mood (registry code 16085582 ), located at A.Weizenbergi 19, 10150 Tallinn, Estonia, hereinafter also Kittel Mood.
Validity of the sales contract, goods and price information
The terms of sale apply to the purchase of goods from the Online Store.
The prices of the products sold in the online store are indicated next to the products. A delivery fee for the goods is added to the price. All prices of goods sold in the Online Store are in euros and VAT is not added.
The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee will be shown to the buyer when ordering.
Information about the goods is provided in the Online Store directly next to the goods.
Making an order
To order the goods, you must add the desired products to the shopping cart. The shopping cart is created when you click the “Add to cart” button. By clicking on the “Shopping cart” option, you will see your entire shopping cart with the amount to be paid.
You can change the number of products in the shopping cart. You can also change the quantity of products ordered. Click the “Update Cart” button to confirm your change. Click the “Go to pay” button to continue ordering. You will be redirected to the subscriber details page.
On the Customer Details page, enter the required information, the recommended delivery method, and click the “Submit Order” button. You will be charged.
Be careful when filling in the fields on the customer information and order confirmation pages, as the accuracy and correctness of this information depends on the fast and trouble-free delivery of the products you have purchased.
The contract for the sale of products shall be deemed concluded (entry into force of the contract) as of the receipt of the amount payable according to the order confirmation to the current account of OÜ Kittel Mood.
Orders placed in the e-shop will be fulfilled as soon as possible, but depending on the availability of the purchased goods within a maximum of 14 working days.
Payment for products
To make a payment, select the payment method you like on the ordering page.
It is possible to pay for the products with a bank link (Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele) or with a payment card (Maestro, Visa and MasterCard).
When paying with a bank link, be sure to click the “Back to Merchant” button on the bank’s page and do not close the web window before redirecting. Payments are mediated by LHV Pank AS.
The order will be canceled if the purchase amount has not been received in the current account of OÜ Kittel Mood within 5 days.
In case of cancellation of the order or return of the purchased product, the purchase amount will be refunded according to the payment method selected when placing the order. The amount paid by transfer is returned to the account from which the paid amount was received.
If the ordered goods cannot be delivered due to the expiration of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. Delivery costs) will be refunded immediately, but not later than within 14 days of sending the notice.
The goods are sent to the following countries: Member States of the European Union and Great Britain
In order to receive the goods, the buyer can choose between the partners of different parcel machines.
Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days. The right of withdrawal does not apply to custom-made products.
The right of withdrawal does not apply if the buyer is a legal entity.
In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or have signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
In order to return the goods, an application for withdrawal from the purchase of the goods must be submitted to the e-mail address email@example.com no later than within 14 days of receipt of the goods.
The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the online store shall return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.
The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that the item has been returned, whichever is earlier.
The shipping cost of returning the goods is to be borne by the buyer.
The Online Store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the Online Store is significantly lower than the market price of the goods due to an error.
Right to lodge a complaint
The buyer has the right to contact the online store within 14 days at the latest by sending an e-mail to firstname.lastname@example.org
The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.
The online store shall respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The processor of personal data in the Online Store is OÜ Kittel Mood.
Kittel Mood forwards the personal data necessary for making payments to the authorized processor of LHV Pank AS
Personal data is data that Kittel Mood collects for the purpose of fulfilling or contacting a customer’s purchase or order.
The collection of the customer’s personal data can take place in the following ways: when making a purchase or order in the Online Store or in the e-ordering environment (Facebook account).
Kittel Mood processes personal data for the following purposes:
Upon concluding a sales transaction or provision of a service (incl. Orders);
To contact the customer;
Customer relationship management;
For delivery of goods;
To improve service.
Personal data to be processed
All data on an identified or identifiable natural person shall be considered personal data. The personal data processed by Kittel Moodi are:
First and last name;
Postal address, delivery address;
The customer’s rights with respect to Kittel Moodi in relation to personal data are:
Request access to your personal data;
Request the correction of your personal data;
Request a restriction of your personal data;
Request the deletion of your personal data;
Request the transfer of your personal data;
Withdraw previous consent to the processing of personal data if justified;
Submit a complaint to the data protection supervisory authority (Data Protection Inspectorate, www.aki.ee, email@example.com).
If the buyer has any complaints regarding the Online Store, they must be sent to the e-mail address firstname.lastname@example.org
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint in the commission is free of charge.
